Virtual care flexibility policies

The current policy “flexibilities” exist today because the Centers for Medicare & Medicaid Services (CMS) is permitted to expand the telehealth benefits on a temporary and emergency basis under the 1135 waiver authority, which allows the U.S. Department of Health and Human Services (HHS) to waive various requirements during a time of national emergency.

Two conditions must be met for the 1135 waiver to be issued: 1) a presidential declaration of disaster or emergency (President Trump invoked this authority) and 2) the HHS secretary declares a public health emergency under Section 319 of the Public Health Service Act. Both were met as of March 13. The public health emergency – which also enables many virtual care flexibilities – can be extended every 90 days; it was last renewed on April 26 and is next up for renewal on July 25.

The president, however, can end the national disaster emergency via proclamation. While CMS and HHS have expressed support for trying to retain many of these policies long term, most of the changes will require congressional action to revise existing laws.
